1. Acceptance of Terms
By accessing or using 1ClickForm ("Service"), you agree to these Terms of Service ("Terms").
If you do not agree, do not use the Service.
2. Description of Service
1ClickForm is browser-based workflow acceleration software designed for licensed insurance professionals.
The Service:
- Captures structured data at user direction
- Stores structured client data in secure cloud infrastructure
- Prefills web-based quote forms
- Does not automate login
- Does not bypass authentication
- Does not submit forms automatically
Users remain solely responsible for reviewing and submitting all quote information.
3. Data Roles
You are the Data Controller of any client information processed through the Service.
DoHeavy LLC acts solely as a Data Processor, processing data only to provide the Service.
You represent and warrant that:
- You have lawful authority to process client data.
- Your use of the Service complies with applicable laws and carrier agreements.
4. User Responsibilities
You agree to:
- Maintain the confidentiality of your login credentials
- Ensure all submitted quote information is accurate
- Review all prefilled data before submission
- Use the Service only within authorized systems
You are responsible for compliance with:
- Insurance regulations
- Carrier agreements
- Data protection obligations applicable to your business
5. Payment & Subscription
Subscriptions are billed monthly per user seat.
A 7-day free trial may be offered. Credit card required.
You may cancel at any time. Access continues through the current billing period.
Fees are non-refundable except where required by law.
6. Data Storage & Security
Client data captured through the Service is stored in secure cloud infrastructure.
DoHeavy LLC implements commercially reasonable safeguards including:
- Encrypted transmission
- Encrypted storage
- Access controls
However, no system can guarantee absolute security.
7. Prohibited Use
You may not:
- Use the Service to access systems without authorization
- Reverse engineer, copy, or distribute the software
- Attempt to interfere with the Service's operation
- Use the Service in violation of carrier or regulatory requirements
8. Disclaimer of Warranties
The Service is provided "as is" and "as available."
DoHeavy LLC makes no warranties regarding:
- Continuous availability
- Compatibility with all carrier portals
- Error-free operation
The Service assists workflow efficiency but does not replace professional judgment.
9. Limitation of Liability
To the maximum extent permitted by law, DoHeavy LLC shall not be liable for:
- Lost profits
- Lost business
- Data loss
- Indirect or consequential damages
Total aggregate liability shall not exceed the total subscription fees paid by you in the three (3) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless DoHeavy LLC from any claims arising from:
- Your misuse of the Service
- Unauthorized processing of client data
- Violation of laws or carrier agreements
- Inaccurate or incomplete quote submissions
11. Termination
We may suspend or terminate access for:
- Non-payment
- Violation of these Terms
- Misuse of the Service
Upon termination, stored data may be deleted within a reasonable timeframe.
12. Governing Law
These Terms are governed by the laws of the State of Texas.
Venue for disputes shall be in Texas courts.
